November 21, 2022 \u2013 Individuals with disabilities and organizations<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">representing people with disabilities today filed a lawsuit in federal court against the District of<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">Columbia over its street redesign projects that violate the Americans with Disabilities Act (ADA)<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">and related laws. The complaint states newly constructed bicycle lanes create barriers to safe,<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">accessible on-street parking, curb ramps and pedestrian crossings for people with mobility<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">disabilities, including those who use wheelchairs and walkers. It also alleges that the District does<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">not have enough accessible on-street parking generally to comply with the ADA.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">On certain streets, such as 17th Street NW, the District constructed protected bicycle lanes whose<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">location forces wheelchair users to risk being injured by passing cyclists when they attempt to<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">transfer from their vehicles into their wheelchairs and onto the sidewalks. Even wheelchair users<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">who do not drive but travel via wheelchair-accessible buses and vans risk serious injury because<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">the District\u2019s bicycle lanes obstruct pick-up and drop-off areas. In addition, the placement of tire<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">stops and posts prevent wheelchair users and other people who need curb ramps from accessing<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">them. Some designated-accessible on-street parking is not accompanied by a curb ramp at all.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">\u201cWe aim to remedy this systemic discrimination by the District against residents as well as visitors<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">with mobility disabilities who are prohibited from moving about this beautiful city with the same<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">freedom and ease as those without disabilities,\u201d says Richard A. Simms, Executive Director, the<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">District of Columbia Center for Independent Living, Inc. (DCCIL), one of the organizational<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">plaintiffs in the case.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">Approximately 12 percent of residents \u2013 tens of thousands of people \u2013 in the District have mobility<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">disabilities, according to the Centers for Disease Control and Prevention. About three-quarters of<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">the disabled population in the District is African-American, and one-third is over the age of 65,<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">according to a 2015 Census Bureau report. Due to the increasing inaccessibility issues, the DCCIL<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">has struggled to provide its complimentary transportation services for people with disabilities.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">Ed Hanlon of the Dupont East Civic Action Association, another organizational plaintiff in the<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">case, says: \u201cUnfortunately, the District has chosen to build bike lanes in a way that blocks safe<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">curb access for the disabled and the elderly, rendering them unable to fully participate in all aspects<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">of our community \u2013 shopping, dining, visiting doctors, going to church or synagogue. Bike lanes<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">may not be appropriate on every street, but we can construct accessible street designs that include<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">bike lanes in a way that protects the rights of the disabled and the elderly to safely reach the curb.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">This does not have to be a choice between accessibility and bike lanes.\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">1254008 v1<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">Despite the District Department of Transportation (DDOT) claiming to \u201cnot discriminate against<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">qualified individuals with disabilities on the basis of disability in its services, programs or<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">activities\u201d and \u201chonor and work to satisfy the requirements,\u201d the agency failed to hold public<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">meetings and refused to work with community members on the design of the bicycle lanes.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">\u201cIt is unfortunate that this lawsuit had to be filed,\u201d says Andrew Bizer of Bizer &amp; DeReus, co-<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">counsel for the plaintiff. \u201cMy clients tried time and time again to educate \u2013 not litigate. However,<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">D.C.\u2019s Department of Transportation refused to listen to my clients\u2019 commonsense objections to<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">the delinquent design of the bicycle lanes. We are confident that this lawsuit will force the District<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">to create new and better bicycle lanes that do not discriminate against people with disabilities.\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">The plaintiffs also have sued because the District claims that it is not \u201clegislatively mandated<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">outside of the central business district\u201d to provide accessible parking to individuals with<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin:0in 0in 8pt;line-height:107%;font-size:11pt;font-family:Calibri,sans-serif\"><span style=\"font-size:10pt;line-height:107%;font-family:Arial,sans-serif\">disabilities.
