\u201cIrreparable Harm\u201d from Premature DCRA Permit<\/font><\/b><\/u><\/span><\/div>\n<p><span style=\"font-family:verdana,sans-serif\"><br \/>On Wednesday, February 19, 2020, DC\u2019s highest court, the DC Court of Appeals, stopped work at McMillan Park and Sand Filtration Plant (1st Street NW and Michigan Avenue NW) by granting an injunction against an August 2018 DCRA-issued demolition permit. \u00a0<\/p>\n<p>The injunction was requested by Friends of McMillan Park and supported by individual members of the Save McMillan Action Coalition, including residents who live near the historic public site.<\/p>\n<p><u><i>In its two-page decision the Court found that:<\/i><\/u><br \/><\/span><\/p>\n<ul>\n<li><span style=\"font-family:verdana,sans-serif\">There is \u201csubstantial likelihood of success on the merits\u201d of the case against demolition because DCRA had not made an \u201cindependent determination\u201d that the developers \u201ccould complete the project,\u201d<\/span><span style=\"font-family:verdana,sans-serif\"><\/span><span style=\"font-family:verdana,sans-serif\"><\/span><\/li>\n<li><span style=\"font-family:verdana,sans-serif\">The \u201cplanned demolition\u201d would cause \u201cirreparable harm\u201d and thereby foreclose a \u201cmeaningful decision\u201d on the merits of preservation, and<\/span><span style=\"font-family:verdana,sans-serif\"><\/span><span style=\"font-family:verdana,sans-serif\"><\/span><\/li>\n<li><span style=\"font-family:verdana,sans-serif\">On balance the \u201cpublic interest\u201d \u201cweighs in favor of staying demolition\u201d because McMillan is a designated historic site under District law which says that the \u201cperpetuation of properties of historical, cultural and aesthetic merit\u201d promotes the \u201chealth, prosperity and welfare\u201d of the people of the District. <\/span><br \/><span \/><\/span><\/div>\n<div><span style=\"font-family:verdana,sans-serif\"><\/span><\/div>\n<p><span style=\"font-family:verdana,sans-serif\">The Court injunction gives the Office of Administrative Hearings (OAH) the chance to hear claims against DCRA\u2019s issuance of the demolition permit through an appeal brought by members of the Save McMillan Action Coalition.\u00a0 The Court expects the OAH trial to \u201cproceed expeditiously.\u201d<\/p>\n<p><\/span><\/p>\n<blockquote class=\"gmail_quote\" style=\"margin:0px 0px 0px 0.8ex;border-left:1px solid rgb(204,204,204);padding-left:1ex\"><p><i><span style=\"font-family:verdana,sans-serif\">Mrs. Jimmie Boykin, living in the area since 1969, is one of the Park neighbors worried about the environmental impacts and lack of real traffic studies before DCRA issued the permits. \u201cThis is an important victory for the rule of law by our highest court that should send a strong message to what has been an unaccountable DC Department of Consumer and Regulatory Affairs as well as other city agencies,\u201d Boykin said. <\/span><\/i><br \/><span style=\"font-family:verdana,sans-serif\"><\/span><\/p><\/blockquote>\n<p><span style=\"font-family:verdana,sans-serif\"><br \/><\/span><\/p>\n<div><span style=\"font-family:verdana,sans-serif\"><b>Organizers have put up a website showing the many reasons to \u201cHalt the Demolition\u201d of McMillan Park: <a \/><\/span><\/p>\n<blockquote class=\"gmail_quote\" style=\"margin:0px 0px 0px 0.8ex;border-left:1px solid rgb(204,204,204);padding-left:1ex\"><p><i><span style=\"font-family:verdana,sans-serif\">Cynthia Carson who lives nearby the Park said, \u201cWith this critically important Stoppage by the Court, we can now work with appropriate public and private parties to address a real plan for McMillan that preserves the park and protects and serves the neighborhood and the city.\u201d<\/span><\/i><br \/><span style=\"font-family:verdana,sans-serif\"><\/span><\/p><\/blockquote>\n<p><span style=\"font-family:verdana,sans-serif\"><br \/>Among the many ideas being put forward are multiple uses of the subterranean caverns, as well as open parkland, overseen by a newly constituted public conservancy that would raise the funds to manage the site for public use in the best interest of the
